This legislation amends the UK ETS Order, Free Allocation Regulation, and Activity Level Changes Regulation. The definition of “ceasing operation” now refers to the permanent cessation of regulated activities. Operators must notify the regulator when all authorized activities have ceased, and the regulator has the authority to determine when cessation is considered permanent for UK ETS purposes. The Order also requires operators in receipt of free allocation to submit activity level reports when they cease operation.
